The Supreme Court addressed the priority of applications for the release of a vacant residential building under the U.P. Urban Buildings (Regulation of Letting, Rent & Eviction) Act, 1972, specifically under Section 12(3) & (4) and Section 16(1). The Court held that when both a landlord's application for release and a former tenant's application for re-allotment are received, the landlord's application must be given priority. The Court upheld the decision of the Additional District Magistrate granting the landlord's application for release of the disputed house.
