Judgment text excerpt

The Supreme Court held that Sections 48 and 49 of the Karnataka Town and Country Planning Act, 1961 do not mandate a public inquiry for citizens when revoking or varying a scheme under Section 49(2). The Court affirmed the High Court's interpretation that the State Government has discretion in conducting inquiries and is not required to provide an opportunity for public hearing. Consequently, the appeal was dismissed, upholding the High Court's decision.
