The Supreme Court held that under Section 15 of the Wakf Act, 1954, the Wakf Board has the responsibility to ensure that Imams are compensated for their services, as mosques are registered Wakfs. The Court emphasized that the right to life under Article 21 includes the right to live with dignity, which extends to Imams who perform essential religious duties. The financial difficulties of the Wakf Boards cannot override the fundamental rights of citizens, and thus the Union of India and the Central Wakf Board were directed to formulate a payment scheme for Imams within six months, guided by existing pay scales in Punjab and Haryana.
