Judgment text excerpt

The Supreme Court held that while a conviction can be based on the testimony of a single eye-witness, in this case, the evidence was insufficient to uphold the conviction under Sections 302 and 34 IPC. The Court found that the prosecution failed to establish the identity of the assailants beyond reasonable doubt, as the medical evidence suggested that the deceased was assaulted by only one person. Consequently, the appellant was entitled to the benefit of doubt, leading to his acquittal.
