The Supreme Court held that under Section 16(1-A) of the Prevention of Food Adulteration Act, 1954, a conviction requires the food to contain an adulterant injurious to health. The Court found that the ice-stick sold by the appellant, while containing saccharin, did not contain any adulterant declared injurious to health, thus the conviction under Section 16(1-A) was not justified. However, the Court upheld the conviction under Section 16(1)(a)(i) for selling adulterated food as it did not conform to prescribed standards, altering the sentence accordingly.
