Judgment text excerpt

The Supreme Court held that an arbitration award regarding the distribution of partnership assets does not require registration under Section 17(1) of the Registration Act. The Court clarified that upon dissolution of a partnership, the distribution of assets among partners does not constitute a partition or transfer that attracts registration requirements. The appeals were allowed, reversing the Division Bench's decision which had ruled the award invalid due to lack of registration.
