Judgment text excerpt

The Supreme Court examined the constitutional validity of the Representation of the People (Amendment) Ordinances, 1992, under Articles 14, 19, and 21 of the Constitution. The Court held that the amendments, which restricted countermanding of elections to candidates of recognized political parties and reduced the election period from 20 to 14 days, were arbitrary and discriminatory, violating the equality clause and the right to free speech. Consequently, the Court declared the amendments ultra vires the Constitution.
