The Supreme Court held that under the Requisitioning and Acquisition of Immovable Property Act, 1952, the 'Comparable Sales Method' is a valid criterion for determining market value when evidence of nearby land sales is presented. The Court found that the High Court erred in not considering such evidence and in reducing the compensation awarded. The Court partially allowed the appeal, reinstating a higher compensation amount and clarifying that solatium should be awarded at the rate applicable under the Central Land Acquisition Act rather than the state act.
