The Supreme Court ruled that Rule 4 of the Central Public Works Department Assistant Engineers (Central Engineering Service and Central Electrical Engineering Service) Group 'B' (Confirmation and Seniority) Rules, 1979, which determined seniority based on the date of confirmation, violates Articles 14 and 16(1) of the Constitution of India. The Court held that the method of confirmation leading to unequal treatment among Assistant Engineers appointed through different methods is unconstitutional. Consequently, the Court upheld the Delhi High Court's decision to consider the petitioners for confirmation and fix their seniority accordingly.
