The Supreme Court held that Section 73(2) of the Maharashtra Co-operative Societies Act does not impose a mandatory duty on the Registrar of Co-operative Societies to prescribe a maximum number of members for a society's committee, especially after the deletion of the proviso to Section 27(3). The Court found that the Registrar has discretion in this matter, and since the bye-laws of the appellant bank already prescribed a maximum of 21 members, the election process declared by the Collector was valid. The High Court's ruling was overturned, affirming the legality of the election process.
