Judgment text excerpt

The Supreme Court held that the Motor Accidents Claims Tribunal's finding that the deceased army officer spent half of his salary on personal needs was erroneous, as evidence showed he spent Rs. 1,400 monthly on his family. The Court determined the life expectancy of the deceased should be considered as 70 years instead of 56, reflecting modern life expectancy trends. The Court also ruled that the deduction of 1/3 for lumpsum payment was unjustified and awarded additional compensation for loss of consortium to the widow and minor children.
