The Supreme Court held that the phrase 'for the time being' in Section 28(11) of the U.P. Kehhetra Samiti and Zilla Parishad Adhiniyam, 1961 refers to the actual membership at the time of the no-confidence motion, not at the constitution of the Zilla Parishad. The Court overruled the earlier High Court judgment in Bhaiya Lal v. P.N. Tiwari, 1970, stating it misinterpreted the statutory language. Consequently, the Court confirmed that the no-confidence motion was validly carried with 31 out of 60 members voting in favor, leading to the dismissal of the appeals.
