The Supreme Court held that the post of Director of AIIMS is a tenure post, and therefore, the incumbent cannot be prematurely retired before the completion of the tenure unless justified grounds exist. The Court clarified that once appointed to a tenure post, the individual remains in office until the tenure ends, and the concept of superannuation does not apply. The appeal was allowed, overturning the High Court's dismissal of the writ petition, thereby reinstating the appellant's position as Director.
