The Supreme Court held that under Section 14 of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, a tenant in occupation of premises with the landlord's consent before the Amending Act of 1976 is deemed an authorized tenant, thus regularizing their occupation. The Court found that the tenant had been in continuous occupation since before the Act's enforcement and that no eviction proceedings were pending at that time. Consequently, the appeal was allowed, affirming the tenant's right to remain in possession of the premises.
