The Supreme Court held that under Section 5(3) of the Karnataka Village Abolition Act, 1961, as amended by Karnataka Act 13 of 1978, there is a clear prohibition against the transfer of regranted land for a period of 15 years from 7.8.1978. The Court affirmed that the alienation of land that occurred on 4.12.1982 was null and void due to this statutory bar, thereby dismissing the appeals. The ruling clarified that prior sanction to alienate does not override the statutory prohibition established by the amendment.
