The Supreme Court held that under the Arbitration Act, 1940, specifically Sections 3 and 8, the absence of joint deliberations between arbitrators does not invalidate their awards. The Court ruled that parties to arbitration are not required to know if joint consultations occurred, and in cases of disagreement, the Umpire is entitled to enter upon the reference. The appeal was allowed, overturning the High Court's decision which had deemed the awards invalid due to lack of joint deliberation.
