The Supreme Court held that the respondent, S.K. Sharma, was not entitled to claim seniority as Professor (Senior Scale) from 28.6.1969, as his ad hoc appointment did not constitute a regular appointment. The Court clarified that the approval from the Union Public Service Commission (UPSC) for ad hoc pay and allowances did not confer seniority rights. The Court set aside the Tribunal's order and upheld that seniority should be counted from 29.9.1973, when he was regularly selected according to the rules.
