The Court clarified that arrears paid to employees due to an arbitrator's award are considered 'basic wages' under the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952, and thus subject to provident fund contributions. The judgment of the Division Bench was set aside, affirming that the revised wages are indeed basic wages for the purpose of provident fund contributions.
