The Supreme Court held that for the applicability of Section 331-A of the U.P. Zamindari Abolition and Land Reforms Act, 1950, three conditions must be satisfied: (1) the suit must relate to land held by a bhumidhar, (2) the land must not be declared under Section 143 or 144 of the Act, and (3) the nature of the land must be considered. The Court found that the Civil Court had jurisdiction over the matter as the land was appurtenant to a building and not agricultural land, thus allowing the appeal and reversing the High Court's dismissal of the revision application.
