Judgment text excerpt

The Supreme Court held that the presence of eyewitnesses at the scene of the crime was not free from doubt, and the investigation was tainted due to contradictions in two dying declarations. The Court found that the High Court erred in reversing the trial court's acquittal of the appellant under Section 302 IPC and Section 27 of the Arms Act, 1959, as the prosecution failed to establish guilt beyond reasonable doubt. Consequently, the Court allowed the appeal and granted the appellant the benefit of doubt.
