The Supreme Court upheld the High Court's dismissal of an eviction petition under Section 14(1)(b) of the Delhi Rent Control Act, 1958, ruling that an affidavit by the tenant's brother claiming exclusive possession was inadmissible and not binding on the tenant. The Court clarified that admissions under Section 18 of the Indian Evidence Act, 1872, require the party to be present or authorized, which was not the case here. Consequently, the finding of sub-letting was vitiated in law, allowing the High Court to reassess the evidence.
