The Supreme Court held that under Section 32(1) of the Bombay Tenancy and Agricultural Lands Act, 1948, the appellant became a deemed purchaser of the agricultural land from 1.4.1957, despite the landlord's insanity delaying the right to purchase. The Court ruled that the exemption under Section 88(1)(b) does not retroactively deprive the appellant of his statutory right, as the sale by the landlord's son was invalid during the landlord's lifetime. The appeal was allowed, reinstating the Mamlatdar's decision to fix the purchase price for the appellant.
