The Supreme Court ruled that the petitioner, appointed as Excise Sub-Inspector in 1964 and promoted ad hoc to Excise Inspector in 1972, is entitled to claim seniority and promotion over later appointees under the Uttar Pradesh Subordinate Excise Service Rules, 1983. The Court found that the exclusion of Excise Sub-Inspectors from the promotion channel under the 1967 rules was arbitrary and violative of Articles 14 and 16 of the Constitution. Consequently, the Court directed the State to consider the petitioner for promotion and seniority based on his entire service since 1972.
