Judgment text excerpt
The Supreme Court dismissed the Writ Petitions filed by ex-servicemen claiming 'one rank, one pension' based on a misreading of the Nakara decision. The Court clarified that the Nakara ruling allowed for the liberalized pension benefits to be extended to all retirees, but did not mandate equal pension amounts for all retirees regardless of their retirement date. The claims for equal Death-cum-Retirement Gratuity and merger of Dearness Allowance were also rejected as untenable under the Central Civil Services (Pension) Rules, 1972.
