The Supreme Court held that under Rule 801 of the Family Pension Rules, 1964, family pension is designated for the widow and children of a deceased Railway employee and cannot be bequeathed by will. The Court clarified that the family pension is a welfare scheme and does not confer any title to the employee, as he has no control over it and does not contribute to it. The appeal was allowed, affirming that only those designated under the Rules are entitled to receive family pension, thus rejecting the brother's claim.
