The Supreme Court held that a compromise petition under Order 23, Rule 3 of the Code of Civil Procedure, 1908, is valid and must be acted upon if genuine and lawful. The Court ruled that the sale of property pendente lite, as per Section 54 of the Transfer of Property Act, 1882, is invalid. The Court directed the appellant to pay an additional sum to the respondent and clarified that the alienees had no valid rights under the alleged sale-deeds, ordering them to deliver vacant possession of the property.
