Judgment text excerpt

The Supreme Court held that the agreement between the plaintiff and Sajjid Yar Jung was champertous and opposed to public policy under Sections 23 and 70 of the Indian Contract Act. The Court found that the advance of Rs.75,000 and the share in the estate were inseparable parts of the same contract, thus rendering the entire agreement unenforceable. Consequently, the appeal was dismissed, affirming the lower courts' decisions that the plaintiff could not recover the advanced amount.
