Judgment text excerpt

The Supreme Court held that the Government orders dated September 22, 1955, and November 29, 1958, clearly intended to grant land to the Ziarat Shareef of Hazrat Baba Ibrahim, not to the appellants in their personal capacity. The Court found that the appellants' claim of personal ownership was unfounded as the grants were unambiguous and did not mention their names. Consequently, the High Court's decision to reverse the trial court's findings was upheld, affirming that the land belonged to the Ziarat and not the appellants personally under the Jammu and Kashmir Wakf Act, 1959.
