The Supreme Court held that under Section 68F(1-D) of the Motor Vehicles Act, 1939, no permits could be granted to private operators in the presence of a draft scheme under Section 68C. The Court emphasized that the merits of the private operators' claims were irrelevant when the law forbade the grant of permits. However, for the private operators in C.A. Nos. 940-941, their existing permits could be renewed for a limited period, as they were valid until the final scheme was published under Section 68D(3). The appeals were allowed for C.A. Nos. 937-939 unqualifiedly and qualifiedly for C.A. Nos. 940-941.
