The Supreme Court held that under Regulation 17(2) and 17(3) of the U.P. State Road Transport Corporation Employees Service Regulations, 1981, the Corporation has the discretion to terminate drivers who fail medical tests, without a vested right for alternative employment. The Court clarified that while the Corporation must consider cases for alternative jobs, it cannot be compelled to offer them. The High Court's directive to provide alternative jobs was deemed erroneous, leading to the allowance of the Corporation's appeal.
