The Supreme Court held that under Section 19(1) of the Kerala Water Supply and Sewerage Act, 1986, employees of the Public Health Engineering Department automatically became employees of the Kerala Water Authority. The Court ruled that appointments made prior to the amendment of Rule 9(a)(i) on 30.7.1988 could not be deemed irregular or unauthorized, thus protecting the employees from arbitrary termination. The Court directed the Authority to regularize the services of affected employees, ensuring their rights are upheld in line with constitutional principles.
