The Supreme Court held that the requisition of premises under the West Bengal Premises Requisition and Control (Temporary Provisions) Act, 1947, is valid only for temporary purposes, as established in H.D. Vora v. State of Maharashtra, [1984] 2 SCC 337. The Court found that the Government of West Bengal's notification under Section 4 of the Land Acquisition Act indicated an intention to acquire the premises, thus justifying the retention of possession by the respondents. Consequently, the contempt petition was dismissed as the respondents were not in contempt for failing to comply with the earlier order to hand over possession.
