Judgment text excerpt

The Supreme Court held that under Section 15(1)(a) of the Hindu Succession Act, 1956, the appellant, being the daughter of a predeceased son of Santi, was entitled to succeed to Santi's property in preference to the respondents. The Court clarified that Santi was a limited owner until the Act came into force, after which she became a full owner, and upon her intestate death, succession was governed by the Act. The Court found sufficient evidence to establish that the appellant's father was indeed Santi's son, thus affirming the appellant's claim.
