The Supreme Court held that the Haryana Excise and Taxation Inspectorate (State Service, Class III) Rules, 1969, which prescribed 100 marks for the viva voce test (28.5% of total marks), were arbitrary and contrary to the principles established in Ashok Kumar Yadav v. State of Haryana. The Court ruled that the appellants, who were initially selected based on the correct application of these principles, should be appointed as Excise Inspectors. Although the second interview based on the incorrect marking scheme was deemed illegal, the Court ordered the respondents to appoint the appellants within one month, regardless of any age disqualifications that may have arisen since their initial selection.
