Judgment text excerpt
The Supreme Court addressed the constitutional validity of the transfer of territories under the Constitution (Ninth Amendment) Act, 1960, and subsequent agreements between India and Bangladesh regarding the enclaves of Dahagram and Angarpota. The Court held that the agreements of 1974 and 1982 did not involve cession of Indian territory but rather facilitated the exercise of sovereignty by Bangladesh over the enclaves while retaining Indian jurisdiction over the leased area. The Court reaffirmed the legality of the agreements and their implementation under Articles 1, 3, and 368 of the Constitution of India.
