The Supreme Court held that the selection process for recruitment must adhere to the existing rules and government orders at the time of advertisement, as per Articles 16(1) and 16(4) of the Constitution of India. The Court found that the Government Order dated 9th July 1975, while superseding earlier orders, contained a saving clause for selections pending at the time of its issuance. Consequently, the Court set aside the High Court's order and upheld the validity of the revised list prepared by the Commission in accordance with the earlier rules, affirming that the Government Order was applicable to the pending selection process.
