The Supreme Court held that the absorption of Senior Technical Assistants into the cadre of Junior Engineers was valid, as the cadre had not ceased to exist despite its earlier abolition in 1979. The Court found that the State was aware of the existing Junior Engineers and that the merger order of 8.10.1982 explicitly recognized their status. The Court ruled that the appellants were entitled to the same promotional opportunities as existing Junior Engineers, thus allowing their appeal against the amendment made on 1.3.1986 which limited their promotion prospects.
