The Supreme Court held that under Section 216 Cr. P.C., the addition of charges is only maintainable when there are existing charges against the accused. The Court found that the Magistrate lacked jurisdiction to frame charges against appellants 4 and 5 after they were discharged of all charges. It clarified that once a person is an accused, they cannot be dealt with under Section 319 Cr. P.C., and the application under Section 216 was applicable only to appellants 1 to 3. The orders of the Magistrate and the High Court regarding appellants 4 and 5 were set aside.
