Judgment text excerpt
The Supreme Court upheld the Andhra Pradesh Revised Pension Rules, 1980, which differentiated between government servants based on their retirement dates, specifically those who retired between 1.4.1978 and 28.10.1979 (Part-II) and those retiring on or after 29.10.1979 (Part-I). The Court found that this distinction was not arbitrary and was necessary due to the increase in the retirement age from 55 to 58 years effective from 29.10.1979. The Court dismissed the writ petitions, affirming that both categories of pensioners received equivalent benefits, thus complying with the principles established in D.S. Nakara & Ors. v. Union of India, [1983] 2 SCR 165.
