The Supreme Court held that the requirement of 40% marks for admission to the Law Course applies only to graduates and not to post-graduate students. The appellant, having completed his M.A. with more than 40% marks, was entitled to admission under Regulation 1, Chapter VIII of the Berhampur University Regulations. The Court found that the University improperly denied the appellant's eligibility after he had already been admitted and allowed to pursue his studies, thus ruling in favor of the appellant's right to sit for examinations.
