The Supreme Court held that under the Foreign Awards (Recognition and Enforcement) Act, 1961, foreign awards are executable in India, and any phrase in the Act should be liberally construed to facilitate international trade. The Court clarified that while an award must be executed as it is, it can be interpreted by the court if ambiguous. In this case, the Court found that the arbitrator's award included the costs of reference, which were to be paid, thus allowing the appellant's appeal for those costs to be enforced.
