Judgment text excerpt

The Supreme Court held that under Section 3(4) of the National Security Act, 1980, the day on which a detention order is passed should be excluded when computing the twelve-day period for approval by the State Government. The Court dismissed the petition challenging the detention order, affirming that the approval was valid as it was obtained within the stipulated time frame. Additionally, the Court ruled that the non-supply of the delegation order to the detenu did not constitute a prejudicial error, and emphasized that the clear language of the statute does not necessitate interpretation of legislative intent.
