The Supreme Court held that under Section 13 of the Haryana Urban Rent Control Act, 1973, the Controller has exclusive jurisdiction to order eviction, and thus a civil court lacks jurisdiction to entertain eviction suits. The Court ruled that a decree passed by a court without jurisdiction is a nullity and can be challenged at any stage, including execution proceedings. The appeal was allowed, confirming that the earlier civil court decree was non est due to lack of jurisdiction.
