Judgment text excerpt

The Supreme Court held that the State's undertaking to appoint selected candidates for Assistant District Attorney posts within one year must be honored in spirit, as per Article 32 of the Constitution. The Court found that the State's claim of no vacancies arising within the year was disingenuous, given that 27 new posts were subsequently notified. Consequently, the petitioner, who was selected and ranked 39th, was entitled to appointment against one of the posts, subject to physical fitness requirements.
