The Supreme Court, while adjudicating a writ petition under Article 32 of the Constitution, addressed the issue of promotional stagnation faced by Group 'A' scientists in the Ministry of Health and Family Welfare. The Court noted that these scientists, unlike their counterparts in other ministries, lack promotional avenues as per the rules framed under the proviso to Article 309. The Court held that the failure to provide promotional benefits constitutes discrimination and directed the Union of India to take necessary steps to rectify the situation.
