The Supreme Court held that the orders of the High Court and the Commissioner were unsustainable in law, as Section 71 of the U.P. Municipalities Act, 1916 did not grant the State Government authority to regulate municipal employees' service conditions prior to its 1964 amendment. The Court emphasized that the Municipal Board had the discretion to appoint a Tax Inspector either by promotion or direct recruitment, and the appointment of the appellant was valid as it was made without violating natural justice principles. The High Court's upholding of the Commissioner's order, which was passed without affording the appellant a hearing, was deemed erroneous and the appeal was allowed, reinstating the appellant's appointment.
