The Supreme Court held that the removal of hutments by the Bombay Port Trust is a human problem causing hardship, but the Trust has the right to utilize its land. The Court affirmed that once a cut-off date of January 1, 1981, was established for granting relief to hutment dwellers, it cannot be extended merely due to the passage of time, as this would undermine the Commission's task. The Court directed that only those identified as occupying the hutments for two years prior to the cut-off date shall not be evicted without alternative accommodation being provided.
