Judgment text excerpt

The Supreme Court addressed the implications of the repeal of Chapter III-B of the Rajasthan Tenancy Act, 1955, and its effect on the determination of ceiling areas under the Rajasthan Imposition of Ceiling on Agricultural Holdings Act, 1973. The Court held that rights accrued and liabilities incurred under the repealed provisions are not affected by the repeal, as per Section 6 of the Rajasthan General Clauses Act, 1955. It was determined that cases initiated under the old law could not be continued after the enactment of the new law, which has overriding effect as per Section 3 of the 1973 Act.
