Judgment text excerpt

The Supreme Court ruled that the issuance of a draft notification under Section 3(3) of the Bombay Provincial Municipal Corporation Act, 1949, does not require adherence to the principles of natural justice, as legislative actions are not subject to such requirements. The Court held that the Government's decision to exclude Ulhasnagar from the proposed Kalyan Corporation was valid, as the process followed was part of the legislative framework and did not necessitate a hearing for all parties involved. The High Court's view that the exclusion was irrational was overturned, affirming the Government's legislative discretion.
