The Supreme Court held that Regulation 486(1)(3) of the U.P. Police Regulations is not applicable to criminal investigations, particularly in cases involving the Prevention of Corruption Act, 1947. The Court found that the investigation conducted by an inspector, who was junior in rank to the respondent, was valid under the proviso to Section 5A(1) of the Prevention of Corruption Act. Consequently, the High Court's ruling that the investigation was vitiated in law was overturned, allowing the charge sheet to be submitted against the respondent.
